The Ohio Voluntary Action Program (VAP) recognizes only those environmental investigations and clean-up activities that have been verified by environmental consultants who are certified by the Ohio EPA. VAP Certified Professionals (CPs) possess extensive training and experiential backgrounds to provide guidance and technical oversight for VAP projects, providing assurance that an environmental site assessment, investigation, or remediation has been completed according to the VAP, and enabling the CP to issue a No Further Action (NFA) letter for the property. Upon review of the NFA, the Ohio EPA will determine that the necessary work has been completed and the Director of the Ohio EPA will issue a Covenant-Not-to-Sue (CNS). The CNS protects the current and future property owners from being legally responsible to the State of Ohio for further investigation and cleanup. By involving an experienced VAP CP in an environmental project, interested parties are more likely to move forward with planned reuse of a property.
